GDPR Compliance Consulting

The Law No. 6698 on the Protection of Personal Data (KVKK) directly concerns every business that processes customer, employee, guest, or visitor information. Compliance is not achieved through a few ready-made texts, but by ensuring that every step, from the moment the data enters the business until it is deleted, is structured according to the law.

Our firm provides legal advice to businesses and institutions throughout this process. The current situation is reviewed together, deficiencies are prioritized, necessary texts and procedures are prepared; and regular reviews are planned to ensure compliance continues in daily operations.

How does the adaptation process proceed?

The scope of the steps varies depending on the business, but the order remains the same.

  1. Preliminary meeting and scope

The field of activity, units, software used, and service providers are discussed; the scope and timeline of the work are clarified.

  2. Data inventory

    KVKK articles 4-6

The document identifies which personal data is processed in which unit, for what purpose, and on what legal basis. Special categories of data, such as health and biometric data, are also marked separately.

  3. Information and explicit consent

    KVKK articles 5, 10

Separate information notices are prepared for each relevant group of people, such as employees, customers, guests, and visitors. Explicit consent is obtained only when truly necessary and separately from the information provided.

  4. Transfers and contracts

    KVKK articles 8, 9

Parties with whom data is shared, such as accounting, software, cloud computing, and shipping, are identified. Data processing agreements are drawn up, and a legal basis is established for international transfers.

  5. Security measures and policies

    KVKK Articles 7 and 12

Access permissions, log management, retention and destruction periods, and intrusion response procedures are documented in writing; their applicability is checked together with the technical team.

  6. VERBIS and continuity

    KVKK Articles 12, 16

If registration is required, VERBİS registration is completed or updated. Employees receive awareness training; periodic reviews are planned to address changes in legislation and processes.

Frequently Asked Questions

Does the Personal Data Protection Law only concern large companies?

No. The law covers all natural and legal persons who process personal data. The size of the business only affects the scope of certain obligations, such as VERBİS registration; disclosure, data security, and response to applications are applicable to every business.

Does completing the VERBİS registration mean compliance is complete?

No. VERBİS registration is only one part of compliance. Registration alone is not sufficient without establishing an inventory, information texts, security measures, and internal procedures.

What should be done if a data breach occurs?

First, the scope of the breach is determined and its impact is limited. The Personal Data Protection Board is notified within 72 hours of learning of the breach, and the affected individuals are notified as soon as reasonably possible. Therefore, the intervention procedure must be in place before the breach occurs.

Are there any issues using cloud, email, or booking services located abroad?

These services often involve the transfer of personal data abroad. Since June 1, 2024, the transfer must be based on a decision of adequacy, one of the appropriate safeguards such as a standard contract, or limited exceptions. The standard contract must be notified to the Personal Data Protection Authority within 5 business days of its signing.

Are the GDPR texts prepared before 2024 still valid?

With the amendments that came into effect on June 1, 2024, the conditions for processing special categories of personal data and the rules for transferring them abroad have been revised. Information and explicit consent texts and transfer grounds prepared before this date may need to be reviewed.

The scope of the study is determined by the size of the business, its field of activity, and the types of data it processes. For detailed information, please see below. on the contact page You can reach our office through these channels.
